As a partner and arbitration attorney in the Netherlands (Amsterdam), Remko specializes in advising and arbitrating for nationally and internationally operating companies, government agencies and advisers. Remko heads our Dutch law firm’s arbitration and civil litigation practice.

An important part of Remko’s work as a Dutch commercial lawyer is the reviewing and drafting of various types of arbitration clauses and agreements.

As a Dutch arbitration lawyer, Remko’s prowess extends to representing and advising clients across a spectrum of contractual and supply chain disputes. This encompasses handling cases related to force majeure, monetary claims collection, and executing seizures. His jurisdiction spans all district courts, various arbitration institutes (NAI, ICC, for example), courts of appeal, and the NCC (Netherlands Commercial Court).

Remko supports foreign and Dutch parties in the enforcement of an arbitral award in the Netherlands. In doing so, Remko works with a Dutch bailiff and ensures that your best interests are served at all times.

Delving into areas such as product liability, (EU) product compliance, and ESG-related matters, Remko’s expertise is broad and nuanced. As a legal expert, he is also part of the esteemed “Green Accelerator Programme,” a platform dedicated to fostering solutions to climate change. 

When contracts need to be worked out for parties, Remko will determine whether an arbitration clause under Dutch law will be a good addition. In disputes where arbitration has been agreed, Remko will also initiate proceedings or defend in the arbitration proceedings.

  1. Arbitration case within an umbrella global frachise concept, over the termination of commercial agents’ contracts.
  2. International arbitration case on the qualification of shares, and the obligation to purchase certain shares, or damages.
  3. Drafting of a supply chain cooperation agreement with new ESG clauses on principles, governance, reporting and enforcement of mutual ESG commitments.
  4. One of Remko’s most noteworthy achievements in recent months has been in the termination of complex distribution agreements between an American distributor and Dutch manufacturer. In this, Remko successfully conducted several proceedings on behalf of the US party.
  5. Remko advised a Dutch technology firm on the creation of an agency agreement with a German distributor. Remko’s familiarity with international commercial law allowed him to draft an agreement that protected the Dutch company’s interests while complying with the local laws in Germany.
  6. For several internationally operating manufacturers and distributors, Remko has conducted civil litigation in the Netherlands on pre-contractual liability, contractual failures, and performance of contractual obligations.
  7. His recent work in drafting complex supply and purchase agreements (and general terms and conditions) for the manufacturing industry has also been commendable. Remko has crafted comprehensive agreements that cover every eventuality, taking into account the unique needs and requirements of the client and their business. An example of this is his work for a Dutch processing company entering into a long-term raw material supply agreement with an American producer. His meticulous drafting ensured the Dutch company’s steady supply, minimized potential risks, and incorporated dispute resolution mechanisms aligned with international norms.
  8. Apart from his primary practice areas, Remko has shown an interest in evolving legal trends such, as ESG, and their impact on commercial law. Remko has been proactive in integrating sustainability clauses into his contract drafts and has written extensively about the significance of such clauses in future commercial transactions.
  9. Remko is also a regular contributor to several Industry-related Product Safety events, where he provides insights into the intricacies of Product Compliance and commercial law.
  10. Assisting a company manufacturing and selling E-Bikes in a dispute regarding comparative claims made by one of its main competitors.

Remko has a master’s in law from Tilburg University (2007) and attended the International School of Law at Helsinki University (2008). In 2013 he successfully completed the specialist training course in National and International Contracting Law at the Grotius Academy.

Remko is admitted to the Dutch Bar. Further to this he is a member of DFA, the Dutch Association for Distribution, Franchise and Agency law. He is also a member of the Association for Dutch-German Attorneys.

Remko is also a lecturer at various conferences and master classes for the manufacturing industry.

Remko Roosjen has registered the following principal (and secondary) legal practice areas in the Netherlands Bar’s register of legal practice areas (rechtsgebiedenregister):

Based on this registration, he is required to obtain ten training credits per calendar year in each registered principal legal practice area in accordance with the standards set by the Netherlands Bar.
